Pennsylvania enacts disclosure rule for deceptive AI-generated ads

Pennsylvania approved Act 99 on October 22. It requires a clear disclosure when an advertiser knowingly, recklessly or willfully uses AI-generated or significantly modified image, video or audio content in a way that creates a false consumer perception about a product or service. The law excludes text-only content, evident fiction, parody, satire, commentary and criticism. It takes effect 60 days after approval, on December 21, 2026; the state attorney general or a district attorney may seek enforcement.
